401 Front Door Peep Hole

I have been informed that 401 has a peephole in the fire door. This needs to be checked out to see if any action is required.

Hi Robyne,

This has not been approved that I am aware of and only fire compliant peep holes are permitted to be installed. To install a peephole means that they have penetrated the fire door and in order to remain compliant with the fire safety regulation the door should have been recertified by the owner.

The easiest way to take care of this is to have the Fire Contractor attend to site to undertake an inspection of the door and it is likely that the door will be defected because of the installation. Once we have this in writing we can force that they remove the peep hole and make the door compliant, its likely they will need to install new door.

Hi Jodie. Yes it is ok to install a Fire rated peep hole in your Unit entry Firedoor. They are compliant. Your maintenance personnel can install this. You don’t need me specifically to install it. Just make sure they are a standard Fire rated sight glass. (Not one with monitors or flash attachments)

I advised him that it was possible to install in a fire door but approval was not discussed.

Was approval given to Peter to install the peep hole or did he just go ahead and install it after the email came from advance?

The door belongs to the Body Corporate as it forms part of the boundary of the lot and he should have sought approval.

Hi Graham and Sarah,
I spoke to Jodie and she said Advance Fire had a look at Lot Owners Fire door and said the door was Fire Compliant. Therefore the owner should have a Certification Certificate to forward to Sarah and the Committee.
Sarah is there any other issues that could arise if the Committee approves the peep hole? i.e. if the door get a split because it may not have been installed correctly then the owner would have to pay for a new Fire door. I know it sounds far fetched but just wondering.

Hi Graham,

Thanks for your email. The Lot owner is the liable party as they have made an alteration to the Common Property without authority from the Body Corporate Committee.

Based on the information Jodie provided, she has provided the lot owner an answer to the question if the peep hole was possible and did not give permission to proceed and therefore management are not liable for any costs related to this.

The By-Laws are very specific in relation to common property:

  1. Damage to Common Property
    An Owner or Occupier of a Lot shall not mark, paint, drive nails or screws or the like into, or otherwise damage or deface, any structure that forms part of the Common Property except with the consent in writing of the Body Corporate, but this by-law does not prevent an Owner or person authorised by him from installing:
    (a) Any locking or other safety device for the protection of his Lot against intruders; or
    (b) Any screen or other device to the Internal of his Lot to prevent entry of animals or insects upon his Lot.
    However, that any such device must be constructed in a workmanlike manner, maintained in a state of good and serviceable repair by the Owner, not detract from the amenity of the Scheme and be consistent with the architectural theme of the Building.

The Body Corporate needs to formally consider the request to install the peep hole as this is an alteration to the common property and sets a precedent. If the Committee approves the application, then obviously the appropriate approval conditions need to be included as part of that approval which will then form part of the records for all future owners. The owner needs to supply the Body Corporate with the appropriate certification for the Body Corporate records.

My understanding based on Jodie’s email that the peep hole is compliant however if the Committee approves the peep hole, if at any point after inspection If the door is defected at any time due to the peep hole, the lot owner will be required to undertake any repairs/replacements necessary in order to be compliant with the Fire Regulations.
