Sarah/Gina, can you please confirm that only 1 dog was ever approved?
If so, please issue them the appropriate email to the lot owner regarding this matter.

Dear Committee,
After further investigation, in December 2020 Kylee had submitted two identical pet applications and a previous employee had only forwarded Sarah one application (possibly thinking it was a double up due to the similarities).
Both dogs are jack Russell x mini foxy (JJ and Max) however on body corporate records, only JJ has been approved.
I have attached the original application and Kylee has completed a new application form.
Can you please advise if you approve or decline?
The decision can be ratified at the upcoming Committee Meeting.

Dear Committee,
Please see below email from the owner of 1503 in relation to their application being denied. They have advised that they will continue to bring the two dogs to the lot and further will engage legal counsel if required.
I have read through the By-laws which state the following:
- Keeping of Animals
Subject to Section 181 (1) of the Act, an Owner or Occupier of a Lot shall not, without the prior approval in writing of the Committee, bring or keep any pet or animal upon his Lot or the Common Property.
It does not state in the By-law that each Lot is only permitted to keep a maximum of one pet within their lot and I am concerned that if the lot owner were to challenge this then they may be successful based on past precedents set by the BCCM.

Hi Sarah,
Thankyou for your feedback regarding our application to keep our family dogs in our property at ROTS.
We are both surprised, and disappointed to hear that the application has been refused, especially in light of our current holiday plans.
Given the administrative history of this situation, and the fact that our two dogs have been coming with us to the property for some two years now, it does come as a shock to be told that they are no longer allowed to stay with us.
Further to the fact that there is actually no statutory by-law preventing us from having two dogs at the property, you should also be aware that I suffer from a medical condition which is treated in part by the companionship of our two dogs. This is a personal issue which I am reluctant to disclose, but sadly this outcome has left me with little choice. I have requested a letter from my doctor which will confirm this for you, and I will provide a copy for your records in due course.
Accordingly, we request that you inform the committee that we will continue to take both of our dogs with us to our property. Should they choose to dispute this then we will have little option but to engage legal counsel to resolve the matter. We hope that it will not come to that.
